Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of AI Meme Generatorand any related websites, applications, and services (collectively, the “Service”) provided by AI Meme Generator(“we,” “us,” or “our”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@creatememes.ai if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

Your content

The Service lets you create memes from text prompts, links, or screenshots (“User Content”). You retain ownership of User Content you create, subject to these Terms.

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, and display it solely as needed to operate, improve, and provide the Service to you.

You are solely responsible for your User Content and represent that you have all rights necessary to upload it and that it does not violate the law or anyone’s rights.

Acceptable use

You agree not to use the Service to:

• Generate content that is illegal, harassing, hateful, threatening, or sexually explicit involving minors.
• Infringe the intellectual property, privacy, or publicity rights of others.
• Impersonate any person or misrepresent your affiliation with any person or organization.
• Reverse engineer, scrape, or attempt to disrupt the Service or any of its underlying systems.
• Use the Service to develop a competing product or to train another machine-learning model without our express permission.

We may remove content and suspend or terminate accounts that violate these rules.

Subscriptions and billing

Paid plans are billed in advance on a recurring basis (monthly or annual) and renew automatically until cancelled. You authorize us and our payment processors to charge your selected payment method.

You can cancel a subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. Except where required by law, payments are non-refundable.

We may change our prices from time to time. Any price change will apply to billing cycles that begin after the change is announced.

Intellectual property

The Service, including its software, design, logos, and content (other than User Content) is owned by AI Meme Generator or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

Third-party services

The Service may integrate with or link to third-party services, such as Slack, Discord, or social platforms. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the content or practices of any third-party service.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, accurate, or error-free.

AI-generated outputs may be inaccurate, offensive, or otherwise unsuitable. You are responsible for reviewing outputs before sharing or relying on them.

Limitation of liability

To the maximum extent permitted by law, AI Meme Generator and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, or (b) USD $100.

Indemnification

You agree to defend, indemnify, and hold harmless AI Meme Generatorfrom and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your breach of these Terms.

Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. On termination, the rights granted to you under these Terms will end, but provisions that by their nature should survive will continue to apply.

Governing law

These Terms are governed by the laws of the jurisdiction in which AI Meme Generator is established, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts of that jurisdiction.
